GENERAL TERMS AND CONDITIONS OF USE

These terms and conditions govern the use of the site called "INSTITUTIONAL SITE" or just "Site".

The General Terms and Conditions of Use constitute a compilation of the main rules that must be observed by all those who access the Site and use its functionalities.

As a condition for accessing and using the functionalities of our site, the User (any visitor who accesses the site and/or uses its functionalities) declares that they have read the rules of this document and its Privacy Policy fully and carefully, and are fully aware of and in agreement with them.

1. Use of the Site

It is possible to browse the site without registering/logging in to an access account. On the main page, the User will have access to a link to redirect them to the other sites of our group to buy tickets for the water park, book accommodation, book hotels with airfare included and buy the experiences we offer, in which case only the general conditions described below will apply.

In the case of access to the chat, it will be possible to provide personal data depending on the User's demand, who will need to be aware of the Privacy Policy supplementary to these Terms.

2. Users' duties

Users must not use the site to:

Violate or solicit the violation of any applicable local, state or national law or regulation;
Violate the rights of any third party, including but not limited to intellectual property rights, contract rights, privacy rights or rights of publicity;

Engaging in any form of fraud; and
Engaging in or facilitating the unsolicited mass transmission of e-mails or spam.

3. Sanctions for Non-Compliance with User Duties

If the User uses the Website to commit any of the above acts, we may, at our sole discretion, cumulatively (where applicable):

Apply a reasonable sanction, depending on the nature of the infringement; and/or
Adopt the legal sanctions for the configuration of felonies or misdemeanors, or civil liability for damages caused to other Users or to the Site.

4. Our responsibilities

The Site and its functionalities are presented to Users as they are available, and may undergo constant improvements and updates, obliging us to:

Preserving its functionality, with unbroken links and using a layout that respects usability and navigability, whenever possible;
Display the functionality in a clear, complete, precise and sufficient manner so that there is an accurate perception of the operations carried out;
Protect, using the state of the art available, the data collected by the functionality made available;
Beach Park endeavors to maintain the continuous and permanent availability of the site, and there may be temporary unavailability due to necessary maintenance or even due to force majeure, such as natural disasters, failures in communication systems and Internet access or third party events that are beyond its control and responsibility.

If this happens, we will do everything in our power to restore access to the site as soon as possible, within the technical limitations of your services and third-party services on which you depend to stay online.

Any maintenance procedures that cause the website to be unavailable for long periods will be informed through official communication channels, such as e-mails, official social media profiles or telephone support.

The User does not have any right to demand the availability of the site, nor can they claim compensation or damages if the site remains offline, regardless of the reason.

We are not responsible:

For any problems or malfunctions that occur in the devices and equipment of Users and that result directly or indirectly from the regular use of the website.

For any direct or indirect damage caused by third party events, such as, but not limited to, hacker attacks, system, server or internet connection failures, including software actions that may in any way damage physical or logical assets or the connection of Users as a result of accessing, using or browsing the website, as well as the transfer of data, files, images, texts, audios or videos contained therein.

By Users browsing the external links made available on the site, their duty is to read the General Terms and Conditions of Use and Privacy Policy of the resource accessed and act as determined.

By not verifying, controlling, approving or guaranteeing the adequacy or accuracy of the information or data made available on such links, they are therefore not responsible for any damage, loss or harm caused by visiting such sites, and it is up to the interested party to verify the reliability of the information and data displayed there before making any decision or performing any act.

We have our own document, called the Privacy Policy, which regulates the processing of data collected on the site. It is an integral and inseparable part of these Terms and Conditions of Use and can always be accessed via the link at the bottom of the page.

If any provision of the Privacy Policy conflicts with any other provision of this document, the more specific provision shall prevail.

The commercial use of the name, designs, business name, trademark, or domain name, as well as the contents of the screens relating to our services and the infographics, articles, columns, widgets, programs, databases, documents and other utilities and applications that allow the User to access and use their User account are our property and are protected by all applicable laws and treaties.

The User acknowledges that the Website is protected by laws and international treaties relating to intellectual property. The organization, structure, sequence, logic, flowcharts, object code and source code of the site constitute and/or embody trade secret, copyright and/or other intellectual property rights exclusive and unpublished to us, who reserve and own all rights, title and interest therein.

Commercial use of any trademark, patent, copyright, trade secret, software, confidential information or any other intellectual property right, whether registered or not, owned by us or by a third party who has licensed it, is not permitted without our prior express authorization.

Likewise, the total or partial reproduction, for commercial purposes, of any trademarks or any other intellectual property rights of our group or of a third party that has licensed it, is not permitted without its prior and express authorization.

By virtue of our partnerships or because we believe that it may be of interest to you, we may link on our site, at our sole discretion, other websites and Internet functionalities, without this meaning that these websites are owned or operated by our company.

We have no control over such websites and therefore shall not be responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with use of or reliance on any such content, goods or website available on or through any such website or resource.

Therefore, Beach Park reserves the right to modify them at any time, according to its purpose or convenience, such as for the adequacy and legal compliance of a provision of law or rule that has equivalent legal force, and it is up to Users to check them whenever they access the site.

Tolerance of any failure to comply with any of the clauses and conditions of this instrument shall not constitute a novation of the obligations stipulated herein, nor shall it prevent or inhibit their enforceability at any time.

Should any provision of these General Terms and Conditions of Use or the Privacy Policy published on the website be deemed inapplicable or without effect, the remainder of both documents shall continue in force.

Users acknowledge that all communication made by e-mail (e-mail address provided in their registration) is valid, effective and sufficient for the disclosure of any matter relating to the services offered by the site, as well as the conditions of their provision or any other matter addressed therein, except for the expressly different provisions set forth in these General Terms and Conditions of Use.

9. Applicable Law and Jurisdiction

The General Terms and Conditions of Use described herein are interpreted in accordance with Brazilian law, in the Portuguese language, and the Court of Aquiraz, in the state of Ceará, is elected to settle any dispute or controversy involving this document, unless specific personal, territorial or functional jurisdiction is reserved by applicable law.
